| Acceptable Use Policy for E-mail Service

About this Policy
Please read this document carefully.
It is referred to by the Customer Service
Agreement and forms an integral part of that agreement.
Your use of E-mail services provided by Webmarkworld.com and,
or, Webmark New Zealand Limited (in this agreement also referred to as
"Webmarkworld.com", "Webmark",
"company", "our", "we" or
"us") is subject to the terms and conditions of this policy.
The words "you" and "your" in this agreement
mean the individual and, or, organisation who was declared as CLIENT,
or entered as CLIENT on the request for service form, when service was
requested, and also includes a person who generally acts with the
authority of you and, or, your organisation, or on whose behalf
service was requested.
The following policies must be fully complied with at all times to
meet the requirements of this acceptable use policy.
You must also ensure that anybody to whom you provide publishing
access to your Webmarkworld.com hosted site complies with this policy.
Use of Service
The Webmarkworld.com E-mail Service may be used for most types of
lawful business purposes to communicate and conduct business using the
Internet.
Unsolicited E-mail
The Webmarkworld.com E-mail Service may NOT be used for mass mailing a
message to people who would not otherwise choose to receive it.
Some examples may include, though are not limited to:
Chain letters; Pyramid schemes (including multilevel marketing);
Get rich quick or make money fast schemes; mass marketing of pharmaceuticals
or vitamins; distribution of links to adult-material related
Websites.
The Webmarkworld.com E-mail Service may NOT be used for sending
commercial or non-commercial messages attempting to promote or sell a
product, service, or idea to one or more people without their prior
consent.
The Webmarkworld.com E-mail Service may not be used to promote or
sell any Internet Service Provider (ISP) service including access,
site hosting and e-mail without our prior written permission.
Prohibition of publication, or transfer, of Certain Material
All material sent or transferred using a Webmarkworld.com E-mail
Service must be legal for distribution or publication in the countries of your potential viewers
and the country you connect to the Internet from.
Material of an adult only, sexual or pornographic nature may NOT be
sent or transferred, to or from, the Webmarkworld.com E-mail Service.
Any use of our service which is in our opinion questionable, shall
be examined by us and a determination made by a representative of Webmarkworld.com
as to it’s acceptability or otherwise.
If you are unsure about the content you intend sending, please
check with us prior to ordering or using our service.
Message Attachments
Internet E-mail supports a wide range of document types as message
attachments. Where possible attachment size should be minimised using
a file compression tool such as WINZIP® to reduce delivery delays and
impact on service quality
The recommended maximum message size (including any attached
documents) is 5Mb. You must NOT attempt to send any e-mail message
larger than 10Mb using the Webmarkworld.com E-mail Service. We may
discard without notice, or return any message we consider being
excessive in size to you as undeliverable.
If you have a need to send large messages on a regular basis,
please contact us so we can recommend a more appropriate service.
Message Identification
Messages sent using the Webmarkworld.com E-mail Service must have
a reachable, and valid ‘reply to' address to enable the recipient to
identify and reply to you.
Effect of law: If any provision of this document is found by a
court of competent jurisdiction to be invalid, the parties
nevertheless agree that the court should endeavour to give effect to
the parties' intentions as reflected in the provision, and the other
provisions of the document remain in full force and effect. You agree that
regardless of any statute or law to the contrary, any claim or cause
of action arising out of or related to use of our services must
be filed within six (6) months after such claim or cause of action
arose or be forever barred.
The section titles in this document are included for
convenience only and may have no legal or contractual effect.
